Why a power of attorney?
According to Costa Rican legislation, foreign applicants (either legal or natural persons) without residence in Costa Rica require to appoint an agent with sufficient power of attorney to handle their trademark business in Costa Rica before judicial or administrative authorities.
What is the scope of a Power of Attorney?
A single power of attorney can be limited to just certain types of acts (for instance, renewals or oppositions), specific marks or be comprehensive of the entire person's trademark portfolio. Basically, here is a wide range of limitations and conditions that may be attractive to foreign applicants or trade mark owners. Feel free to discuss with your agent your needs, in order to come up with the solution that best fits your requirements.
Be advised that under most circumstances standardized power of attorney forms contain no limitations. Thus, a single power of attorney can be used to file multiple applications during an indeterminate period of time.
What are the formalities required to execute a Power of Attorney?
A single notarized power of attorney can be used to handle indefinitely a person’s entire trademark portfolio in Costa Rica for judicial and administrative matters (e.g., before the Courts or the Trademark Office).
Currently, the only mandatory requirement is notarization of the person’s signature or its agent, in case of legal persons.
In the past, all powers of attorney executed abroad required to undergo the costly and time-consuming process of consular legalization. However, this is no longer the case since the year 2008.
